31. Ugandan troops should leave Western Kenya

It has been noted that there are Ugandan troops crossing into Kenya to help kibaki suppress dissent against his illegally constituted government.

From telephone conversations with people from the border communities and a corroboration from the standard newspaper article, these allegations appear to be true.

32. The International Community Should Impose Sanctions Against Kibaki And His Corrupt Government

Targeted and broad-based sanctions must be imposed against the illegitimate and corrupt government of Mwai Kibaki.

Everyone knows that the elections were fraudulent and steps must be taken to defend Kenya's nascent democracy. No lasting peace will come to Kenya without justice in the 2007 elections and too much is at stake. The welfare of 150 million people in the East African region is in jeopardy.

The international community should act with haste, because Kenya is a very important country in the region. It has a UN headquarters in Nairobi, the only one in the third world, it is the manufacturing base for east and central Africa, the base for humanitarian operations in the region, the gateway to the interior etc.

Kenya cannot have instability for too long.

34. Absolute Power Corrupts Absolutely

Too much power corrupts one's mind against making just and reasonable decisions that promote peace and protect the rights of citizens.

Adolf Hitler and Musolini Benito are good examples of destructive leadership whose absolute power brought the world to rack and ruin. A civilized world today doesn't have a place for leaders who wield absolute power but those that respect the peoples voice, leaders who feel secure with devolved power rather than those who feel insecure with devolved power.

Any leader who strives to retain too much power is thus only a dictator. The Kenyan president has allowed to too much power to go to his feet rather that his head.

He is using that same to trample on democracy and viciously infringe into the rights of Kenyans who put all their eggs of hope in his basket in 2002.

35. Raila and Kibaki, save our country from anarchy

on the 27th December 2007, Kenyans went to polls in a record turn out to elect a new government.

The process that started peacefully ended in anarchy.

A country all along assumed to be a bastion of peace has been torn apart.

People have become highly intolerant of people not from their own ethnic groups.

37. Fresh elections after Kenya vote rigging

I wish to dispute the just concluded General elections in Which Mwai KIbaki was declared president of Kenya. The election was marred by rigging at the final stage of tallying.

The announced results at the polling stations for about 48 out of 210 constituencies differed from the real results.

When asked about the same, the chairman of the Kenya electoral commission says he is not sure if Mwai Kibaki WON.

38. Refund cancelled airline tickets to Kenya

I made a booking online for two tickets, with British Airways. I was intending to fly to Kenya.

Due to the political crisis in Kenya at the moment, it is not safe to travel to Kenya. I therefore had no choice but to cancel the flights but Kevin and Betty at the British Airways customer service center said that tickets are not refundable no matter what the situation is. They suggested I rebook for another day which will include a "change fee" of $200 per ticket plus the difference in the price of the ticket.

I believe I am not the only one who was affected by this situation. There are numerous of other people out there like me.

39. Political Leaders to proactively restore peace in Kenya

Dear believers in human dignity,

The recent violence in Kenya has caused over 300 people to needlessly lose their lives, and 100,000 people to lose their livelihoods and homes.

Furthermore the violence and tensions have caused a threat to stability within the region of East Africa. Not just political stability but economic as well.

The economy ground to a halt and millions of shillings worth of property has been destroyed.

This is all evident from the broadcasts from CNN, Al Jazeera, and local news networks like Nation TV (www.youtube.com/ntvkenya).

All this has been caused by the announcement of the presidential race in Kenya where incumbent was declared the winner of the recently held elections. There has been allegations of rigging from both international and local observers.

40. Appeal for Intervention In Kenya

Mr. George Bush
The President
United States of America,
The White House,
1600 Pennsylvania Avenue NW
Washington, DC 20500

12/31/07

APPEAL FOR INTERVENTION IN KENYA

As Kenyans living in the United States, we wish to thank your government for swift condemnation of the flawed electoral results tallying process, as was pointed out by poll observers, and the subsequent announcement of the same results by the electoral commission in Kenya, and seek the US government necessary intervention to avert the crisis that Kenya has been plunged into.

The malpractice which was a blatant abuse of the essential tenets of the democratic electoral process has compelled Kenyans to denounce the results, which saw the hurried and unprocedural swearing in of Mwai Kibaki, through street protests. The government’s response by unleashing its security apparatus on Kenyans has led to the unrest that has culminated into a grave humanitarian situation that has seen the loss of lives, property, restricted movement, muzzled press and media, displaced families, lack of food and water supplies. This amounts to abuse of human rights recognized in the UN Human Rights Charter and Kenyans’ legal rights enshrined in the constitution of the land. It has also highly polarized Kenya’s multi-ethnic communities against Mwai Kibaki’s Kikuyu ethnic group; this if not stemmed fast enough, could degenerate into massive losses of lives and property.

The Electoral Commission of Kenya (ECK) declared Mwai Kibaki the winner amid calls for a re-tally of the vote results from the Chief Observer of the EU Election Observation Mission (EU EOM), Mr. Alexander Graf Lambsdorff, Member of the European Parliament; Mr. Kipkemei arap Kirui, an officer with ECK; and members of the diplomatic missions in Kenya specifically the US Consulate, the British High Commission and the Canadian Embassy. This cast deep credibility concerns of the whole process.

42. Kibaki should not step down; Raila should concede and dialogue

President Mwai Kibaki won the Kenyan Presidential elections in spite of the ongoing sensational allegations of irregularities.

We, truly patriotic Kenyans in Diaspora hereby urge the foreign media, foreign missions in Kenya, the UN, Kenyan Missions abroad, the people of Kenya in Diaspora and at home in Kenya, and the world at large not to be misled to think that the current tribal violence is sorely because of vote-counting irregularities. There are also allegations of massive rigging and voter-intimidation by Raila's ODM party in Nyanza Province and other ODM strongholds during the voting itself, as well as bloating of vote counts the same ODM strongholds. This allegations need to be investigated. Nyanza and other ODM strongholds were too hostile even for independent observers to go and witness the alleged malpractices.

Any disputes should therefore be addressed through legal channels and not through sensational allegations through the media, petitions calling for Kibaki to resign, violence, wanton destruction of property and killing of innocent Kenyans by ODM supporters, or illegal rallies.

Kenya’s opposition candidate Raila Odinga is therefore not as good or innocent as he and his supporters would have the world to believe. While we do recognize that not all Luo people hate the Kikuyu community, please check http://www.jaluo.com to see hate-mongering articles by some members of Raila's Odinga’s Luo tribe against President Mwai Kibaki and the Kikuyu community, as well as other perceived enemies like Presidential candidate Kalonzo Musyoka in the run-up to the Kenyan elections. This group is fuelling violence in Kenya in the hope that Raila will wrest power from Mwai Kibaki through unrest. The world should not be enlisted into such a plot!

43. Kenya's Flawed/Rigged Election On 27 Dec 2007

Mr. Kibaki must step down and give way for Mr. Raila A. Odinga - the people's president because Kibaki is in the office illegally and has imposed himself on Kenyans.

Even though Kenya has struggled to gain democratic space, the behavior of Mr. Kibaki takes Kenya years back into colonial era.

The evidence does not need more corroboration since:
The just ended Kenyan election ECK Boss admits, Yes, vote tallying had problems, admits Kivuitu. And when he demanded all constituency tallies, he found some figures were not the ones he had personally seen, he said. As of Tuesday, he added, the commission had not received the official Form 16 from four constituencies. The forms give the actual figures from constituencies signed by the returning officer.

It is those forms that had raised a furor when ODM leaders disputed the results, arguing that 49 constituencies had not submitted them and that the ECK was merely using a computer generated form that could be done anywhere. He said the officer had shown him forms of two constituencies — Juja and Kieni — whose results had been tampered with and the returning officer had not counter-signed, as is the normal practice. A shocked Mr Kivuitu said: “What surprised me was the files I saw yesterday (Tuesday) were very clean and the two files I saw (previously) were very dirty because of the cancellation.” He had informed his commissioners that he was dissatisfied.

Three issues to note:

1. No Going to Kenyan Courts: The matter cannot be resolved in the Kenyan courts because at the hall where the rigging and manipulation was taking place was the Justice Ministers Martha Karua and Internal Security Minister John Michuki. They were privy to what was taking place and maybe part of the rigging. So they cannot be trusted.

2. No Fare Judgment: Chief Justice took part in swearing the rigged in president at night knowingly the vote was rigged. Thus he is also part of the election problem facing Kenyans now and since judiciary is under his docket, there may not be a fair hearing.

3. Need for interim Government: As indicated by the Kenyan Attorney General Amos Wako that an independent investigation into vote results that led to President Mwai Kibaki's disputed re-election. This may not be possible since all the documents to be relied upon during the exercise have been severely tampered with by the government agents, stolen from KICC by the government that’s determined to erase all the evidence to cover her tracks in the melee and or lacks credibility.

This only gives way for an independent arbiter that can be impartial in the fact-finding mission while an interim government is in place while waiting for fresh elections. This must be within a short time say, three months at most.

All Kenyans know is that Kibaki did not win the elections but has robbed Kenyans.

44. Peace and truth in Kenya and East Africa at large

The legitamacy of the current government of Kenya is questionable given the outcry and demonstration of disgust being expressed by the citizens after the announcement of the presidential results.

The results were further dented when the chairman of the electoral commission when asked in an interview after the announcement was non committal on whether the current president actually won.

To help in the reconciliation process, the truth about the actual winner should be established and if to the reverse then the present results revoked and either the actual winner sworn in or repeat presidential elections be organised by an independent body within three months and treat the present government as interim.

50. Suspend Kenya from the Commonwealth

The Commonwealth, an organization of 54 countries that arose out of the gradual dissolution of the British empire, prides itself on being one of very few international organizations that is prepared to throw members out for violating democratic norms.

Ironically, the Commonwealth’s values are contained in the Harare declaration, agreed in the Zimbabwean capital in 1991, which sets out democracy, fundamental human rights and the rule of law as the basis of membership.

The Commonwealth must suspended Kenya for 12 months over the conduct of its presidential election. A team, comprising the leaders of Ghana, South Africa, EU and UK, should take the action after its observers reported that the election were neither free nor fair. Alexander Graf Lambsdorf, head of the European Union election observer mission, said the vote "tallying process lacks credibility".

The Commonwealth will have little practical or financial leverage over Kenya so suspension is largely a symbolic move, increasing international pressure on the Kibaki regime and sending a message that the Kenyan government’s actions are viewed as illegitimate.

This will make it more difficult for international institutions, such as the World Bank or the International Monetary Fund, to deal with the country as normal. It will hamper Kenya’s efforts to raise funds on the international money markets.

Early last year CMAG - an eight-strong committee of Commonwealth foreign ministers set up to police the Harare declaration - proposed that it should be given terms of reference that would enable it to act earlier on major violations of democratic values, such as the freedom of the media unfortunately exactly what is happening in Kenya at the moment.

African Commonwealth members - especially Tanzania,Uganda and Ghana, whose leaders are on the three-man Commonwealth panel - also have more political and economic leverage over Kenya. They are deeply concerned about both the knock-on economic effects of the crisis in the country, both by directly damaging trade and by decreasing investors’ confidence in the region.

The Commonwealth has adopted a set of principles on democracy, and the rule of law and proper governance, ironically set out in Harare, and those principles have got to be adhered to,So whether Kenya will ever come back into the Commonwealth depends on the basic principles that the Commonwealth believes in - democracy, the rule of law, respect for human rights and the right to vote- being adhered to. If they are, then Kenya should be let back in, if not Kenya shouldn’t be let to stay.

I here by call upon the commonwealth signatory members to take the necessary steps towards this process of suspending Kenya from its seat until further notice.

We appeal to international community to help please! please! we demand the kenyan govn to lift the media ban immediately, the kibaki to step down, demand the electoral process be given the level of seriouseness it deserves.humanitarian assistance.

57. Kibaki Must Step Down

The international community is very much aware that Mwai Kibaki and his Party of National Unity (PNU) rigged the December 2007 Kenyan presidential election.

In recognition of this fact, the European Union, Britain, and the United States have refused to recognize the Kibaki government as legitimate.

As members of the international community, we do not intend to allow this blatant act of disregard for the rule of law and for the will of the people of Kenya to go unchallenged.

The list of evidence of election irregularities compiled in this petition contains widely known facts and has been corroborated by various news sources.

1) All polls taken before the election favored Raila Odinga and his party, the Orange Democratic Movement (ODM), with Odinga leading Kibaki by a margin of 4%. A mid-December report by the government's own intelligence service gave Raila Odinga an even larger lead of 8% to 15% over Mwai Kibaki. As the election drew near, the Steadman poll, which is conducted under the leadership of George Waititu, a close friend of Kibaki's, showed Kibaki catching up to Odinga although the total for the three leading candidates added up to 101%.

2) The Kenyan National Commission on Human Rights (KNCHR) reported that Muslim voters, most of whom were expected to favor Raila Odinga, were denied voter cards in the leadup to the election.

3) Prior to the election, Raila Odinga warned that Mwai Kibaki and his party planned to illegally deploy Administrative Police (AP) as poll agents for the purpose of intimidating voters. While Mwai Kibaki originally denied these allegations, subsequent events showed that Odinga was correct--the East African Standard reported that 65,000 APs were in fact illegally deployed to various parts of the country.

4) Prior to the election, the impartiality and credibility of the Electoral Commission of Kenya (ECK) was jeopardized by Mwai Kibaki's control over the appointment of foreign observers. The East African Standard reported that ECK Chairman Samuel Kivuitu had himself accused the Kibaki "government of selectively inviting international observers for the December polls." Member of Parliament William Ruto of ODM also voiced concern, stating that "Kibaki has gone against a precedence that even brought him to power. The President alone has appointed ECK commissioners. He alone has picked foreign observers. When you put these two issues in the wider picture of the run-up to elections, you see we have a reason to doubt the fairness of the coming polls."

5) Early in the election, when Raila Odinga went to cast his vote at a polling station in his constituency of Langata, he found that his name was missing from the poll register. Furthermore, names beginning in 'A,' 'E' and 'O'--traditionally Luo and Luhya names--were missing.

6) Raila Odinga's ODM party firmly secured the Parliament, winning more than 45% percent of parliamentary seats--that is, at least 95 out of 210 electable seats--compared to Mwai Kibaki's PNU party which secured only 37 seats in total and lost 22 of its original 32 seats. The ouster of the majority of Kibaki's cabinet was regarded by many as a bold statement to the degree to which the majority of the electorate had lost confidence in the Kibaki administration.

7) In Garsen, a mob destroyed 35 ballot boxes on suspicion of rigging.

8) One constituency, Maragwa, reported 115% voter turnout.

9) Although voting ended on Thursday, December 27, the announcement of results from some polling stations was delayed for more than two days because:
a) The aforementioned irregularities compelled numerous complaints from candidates of both parties.
b) ECK returning officers from disputed polling stations could not be located by Kivuitu and had turned off their cell phones.

10) Samuel Kivuitu, chairman of the Electoral Commission of Kenya (ECK), himself acknowledged that the delay would have allowed time for these missing officials or others to rig votes. "This is where cooking could be taking place," said Kivuitu.

11) The ECK failed to address the majority of these concerns raised by Raila Odinga, his ODM party, and the general public and proceeded to announce the obviously illegitimate results, thereby failing in its responsibility to the people of Kenya and lending validity to the debacle.

12) After the ECK announced the results, declaring Mwai Kibaki the winner, the East African Standard reported that an ECK officer alleged that there had been "blatant and shameless alteration of documents" primarily by "information technology officials." This officer said that the Coast and upper Eastern provinces were most affected by rigging, but also named the constituencies of Moyale, Laisamis, Saku and Matuga.

13) A Reuters article also quoted an "election observer who asked not to be named" as having "very little doubt" that the election was rigged.

14) Furthermore, before Kivuitu declared Mwai Kibaki the winner, Alexander Graf Lambsdorff, chief European Union election monitor, stated that there was ``a big question mark over the tallying of results.''

15) After Kivuitu declared Mwai Kibaki the winner, Lambsdorff repeated his misgivings. "We regret that it has not been possible to address irregularities about which both the EU and the ECK have evidence ... some doubt remains as to the accuracy of the result of the presidential election as announced today," said Lambsdorff.

16) Lambsdorff has again gone on record as saying that the tallying process lacked credibility.

17) Prior to Mwai Kibaki's secretive swearing in ceremony, the Kenyan government suspended all live television broadcasts. Coverage of post-election violence, including the government's use of armed police in suppressing demonstrators, has therefore been difficult to verify. In view of the above irregularities, this has had the effect of further eroding any semblance of democracy.

18) Finally, tallies reported by the ECK differed from those announced at polling stations and on television news broadcasts. The New York Times reports that, "The European Union said its observers in one constituency last week witnessed election officials announce that President Kibaki had won 50,145 votes, but on Sunday the election commission increased those same results to 75,261 votes."

Taken as a whole, this evidence is more than enough to declare the presidency of Mwai Kibaki illegitimate and to install the legitimate winner, Raila Odinga, into that office.

58. Register Madaraka Party of Kenya

The "Register Madaraka Party of Kenya" Petition to be sent to "H.E President Mwai Kibaki, Attorney General Amos Wako, and Registrar of Societies"

Madaraka Party of Kenya was formed on June 11, 2005 to champion for the rights of youth, unemployed, poor workers, and peasants. On July 15, 2005, Madaraka Party submitted application for registration to the Registrar of Societies, Nairobi, Kenya.

On January 20, 2006, the Deputy Registrar informed Madaraka officials that "the government has put on hold registration of all political parties till further notice."

On January 29, 2006, the party wrote to the registrar seeking the following information:

1. "Who or which office in the government made the decision to put on hold the registration of political parties in Kenya?

2. Why has the government decided to put a hold on registration of political parties?

3. For how long will the hold be in place?

4. What is to happen to trigger the lifting of the hold on registration of political parties?

5. Under which law has the government based its decision to put on hold registration of political parties? Lastly, Is Kenya still a multiparty democracy or democracy is also on hold till further notice?"

There has been no response as of February 17, 2006.
