1. Defend Constitutional Government

According to the Oath of Office (Charter Section 3.6), every elected public servant swears to “defend the Constitution of the United States and the Constitution and laws of North Carolina” and to faithfully perform their duties of the offices they were entering, “so help me, God.”

When this Oath of Office is violated by public servants, it is the Right of the People to petition for a redress of grievances and to hold those in the public trust accountable to their actions and behaviors in the course of executing their sworn duties. Nevertheless, public recourse cannot be exercised for any “light and transient causes”; rather, demonstrated abuses, of power not delegated, detrimental to the rule of law, endangering the People to even further gross encroachments against their “unalienable Rights” to “Life, Liberty, and the pursuit of Happiness”, must therefore be delineated as evidence of just cause.

Session Law 2009-257, Senate Bill 570, Section 3.2 – The Mayor was denied as the “Official head of the Town government” to “preside at all meetings of the Town Council” and the Deputy Sheriff was illegally ordered to escort him out of the facility – which was not executed. NC General Statute 132-6, Inspection and Examination of Records – Records were secreted and/or tampered with, pertaining to alleged embezzlement up to $400,000 (1999-2006); Records were not duly forthcoming when formally requested by the Mayor, who as a citizen, was also denied access. NC General Statute 143-318.11(a)(6), Closed Sessions – Council members illegally engaged in closed-door discussion (July 14, 2009) regarding the Mayor for questions of character, which must be addressed in Open Session. 4. Contempt & Disregard Toward Indian Trail Citizens/Denied Equal Representation
