Background (Preamble):
The Incest law in Canada states that proof of intercourse is required to apply the incest label. If a biological parent is found guilty of sexual assault this does not mean the incest label applies. We feel this is discriminatory.
If a biological mother sexually assaults her daughter how is intercourse proven? If a parent, grandparent brother, sister is found guilty of sexual assault, the incest label should apply. See Criminal Code of Canada, Section 155.
