Unfair Wage Competition
Section 1. The power of Congress to regulate foreign trade shall not restrict the prohibition of unfair wage competition.
Section 2. Manufactured items and their components imported into the States and Territories of the United States shall be produced at a wage rate not less than the prevailing United States federal minimum wage.
(a) Imported items produced at a wage rate less than the prevailing United States federal minimum wage shall be subject to a pro-rated tariff equivalent to the difference between the production wage rate and the prevailing United States federal minimum wage.
(b) Additional penalties for non-compliance may also be assessed on imported items produced at a wage rate less than the prevailing United States federal minimum wage.
Section 3. Services imported into the States and Territories of the United States through telecommunications networks or by any other method shall be provided at a wage rate not less than the prevailing United States federal minimum wage.
(a) Imported services provided at a wage rate less than the prevailing United States federal minimum wage shall be subject to a pro-rated tariff equivalent to the difference between the service provided wage rate and the prevailing United States federal minimum wage.
(b) Additional penalties for non-compliance may also be assessed on imported services provided at a wage rate less than the prevailing United States federal minimum wage.
Section 4. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.
Section 5. If Congress fails to utilize its power of enforcement, the several States shall have the power to enforce, by appropriate legislation, the provisions of this article.
Section 6. This amendment shall take effect one year after the date of ratification.
